Fluensay

Terms of Service

Last updated: 14 October 2026

1. Scope

These terms apply to your use of Fluensay — the website fluensay.com, the web app and the iOS app — provided by [to be added] ("we", details in the imprint).

2. What Fluensay is

Fluensay helps you practise speaking a language: pronunciation exercises with automatic scoring, conversations with AI partners, listening practice and feedback. Fluensay is currently free and in an early phase; features may change. If we ever introduce paid features, we will tell you the price and terms before you can buy anything — nothing becomes paid automatically.

3. Your account

4. AI and scores

Scores, corrections, conversation replies and feedback are generated automatically, partly by AI (see How Fluensay uses AI). They are practice aids: they can be wrong and are not an official assessment or certificate of your language level.

5. Fair use

Use Fluensay only for your own language practice. Do not try to break, overload or reverse-engineer the service, use it automatically (bots, scraping), or enter unlawful, abusive or other people's personal content in conversations. We may limit or suspend accounts that seriously or repeatedly break these rules; we will tell you why.

6. Content

The exercises, texts, voices and design of Fluensay are ours or licensed to us; you may use them for your personal practice. What you say or write in the app stays yours; you allow us to process it only to provide the service, as described in the privacy policy.

7. Availability

We work to keep Fluensay available but cannot guarantee uninterrupted access, for example during maintenance or outages of our providers.

8. Liability

We are fully liable for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable for breaches of essential contractual obligations, limited to the typical, foreseeable damage. Since Fluensay is currently free, our liability is otherwise limited to intent and gross negligence (§ 521 BGB).

9. Changes and ending

We may update these terms for good reason (e.g. new features or legal changes). We will tell you about material changes in advance; if you do not agree, you can delete your account. You can stop using Fluensay at any time.

10. Law

German law applies; if you are a consumer, the mandatory consumer protection of your country of residence remains unaffected. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
